1. Acceptance of Terms
By accessing or using HDR Boost ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
HDR Boost is an image processing service that converts standard dynamic range (SDR) images to Ultra HDR format. The Service is provided on an "as is" and "as available" basis.
3. Account Registration
To use the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
You must be at least 13 years old to use this Service.
4. Free Tier and Credits
Free Tier
The Service offers a free tier allowing a limited number of image conversions per day. Free tier limits may change at any time without notice.
Paid Credits
Additional conversions can be purchased as credits. Credits:
- Are non-refundable once purchased
- Do not expire
- Are non-transferable between accounts
- May only be used for the Service
We recommend using the free tier to evaluate the Service before purchasing credits.
5. Your Content
Ownership
You retain all rights to the images you upload. We claim no ownership of your content.
Your Responsibilities
You represent and warrant that you have the right to upload and process any images you submit, and that doing so does not violate any third party's rights.
Ephemeral Processing
Uploaded images are deleted immediately after processing. Processed results are available for download for 1 hour only, after which they are permanently deleted. You are responsible for downloading your results within this window.
6. Prohibited Content and Use
You agree not to upload, process, or transmit any content that:
- Is illegal in Canada, the United States, or your jurisdiction
- Contains child sexual abuse material (CSAM)
- Contains non-consensual intimate imagery
- Is designed to harass, threaten, or defame others
- Infringes on others' intellectual property rights
- Contains malware or malicious code
You also agree not to:
- Attempt to bypass any rate limits or security measures
- Use automated systems to access the Service without permission
- Reverse engineer or attempt to extract the underlying models or algorithms
- Resell or redistribute the Service without authorization
7. Account Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for any reason, including but not limited to:
- Violation of these Terms
- Uploading prohibited content
- Abusive or fraudulent behavior
Upon termination, any unused credits are forfeited and non-refundable.
8. Service Availability
We do not guarantee uninterrupted or error-free operation of the Service. We may modify, suspend, or discontinue the Service at any time without notice. We are not liable for any downtime, data loss, or service interruptions.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will meet your requirements
- The Service will be uninterrupted, timely, secure, or error-free
- The results obtained from the Service will be accurate or reliable
- The quality of any products, services, information, or other material obtained through the Service will meet your expectations
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HDR BOOST AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to indemnify and hold harmless HDR Boost and its operators from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third party's rights
- Any content you upload or process through the Service
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Alberta, Canada.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on this page and updating the "Last updated" date.
Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
